NIL Agreements

Chapel Hill, NC – On October 16, the NCHSAA sent the following memorandum to the membership about the rules and process for NIL agreements.


On October 11, an order was signed by Wake County Superior Court Judge Graham Shirley, paving the way for NCHSAA member school students to profit from an NIL Agreement. That order carries with it a requirement to follow a proposed NIL Policy crafted by the State Board of Education (SBOE).

To comply with the policy, we are providing you with the documents linked to this email. One is the SBOE Policy, edited for clarity and emphasis, as well as a form that must be submitted to verify compliance with the policy. Please note the following:

  • A copy of each proposed agreement MUST BE submitted to the school Principal, Athletic Director, Superintendent, and School Board Chairperson BEFORE signing the agreement.
  • A certificate of completion of the NIL education component—the NFHS NIL Course—MUST BE submitted to you, the member school, PRIOR to signing each agreement.
    • The NFHS NIL Course Certificate of completion is a one-time requirement, but the certificate of completion should accompany each Verification Form submitted to the NCHSAA.
  • Once an NIL Agreement is signed, the member school MUST submit each Agreement and the Certificate of NFHS NIL Course Completion to the NCHSAA.
